In a written response to the NCCIA’s letter yesterday, Rizwan confirmed he would pear before the agency as instructed tomorrow (October 2), but said the agency’s letter to him yesterday peared to have completely altered what it said was the reason for its enquiry. When the notice to Rizwan was initially served, Rizwan’s letter said it expressly stated the enquiry had to do with betting and gambling in Pakistan’s cricket. However, yesterday’s NCCIA letter made no such mention of betting but said Rizwan was being investigated under “relevant provisions of PECA 2016”.
PECA refers to the Pakistan Electronic Crimes Act, though the agency did not clarify what provision of that clause Rizwan had violated. The letter from Rizwan’s legal team said Rizwan’s association with a potential betting and gambling enquiry had tarnished his name and integrity without giving him the chance to defend himself because he had not been told what the charge was. It requested clarity on whether the scope of the enquiry had changed, and moved away from gambling and betting to a separate potential breach of the law.
It also questioned whether the NCCIA had spoken to the PCB or ICC’s anti-corruon units at any time when they claimed to be investigating him in relation to possible betting and gambling violations. Rizwan is also understood to have asked again for the return of his mobile phone, which was taken from him in London the day after Pakistan’s defeat in the second Test at Lord’s. He criticized the possible lack of due process regarding the seizure of his phone, saying that he was not provided with any seizure list or custody record for the continued retention of his phone.
Rizwan’s letter is the latest development into what has become a messy, protracted saga which began when the NCCIA began to investigate Rizwan and Imam-ul-Haq, following the fallout from Pakistan’s defeat in the second Test against England, after which both players were among those called back home immediately. While Imam opted to fill out the agency’s questionnaire, Rizwan has chosen to seek legal counsel as the investigation runs its course.
